Terms of Service

The agreement governing your use of the Native Industries Services.

These Terms of Service ("Terms") govern your access to and use of nativeindustriestx.com, the Native Industries marketplace, the Sandhill Crane Flight Co. apparel shop, the Gun Trust Builder, the Collective directory, and all related services (collectively, the "Services"), operated by [LEGAL ENTITY NAME] ("Native Industries," "we," "us," "our").

PLEASE READ CAREFULLY. THESE TERMS INCLUDE A BINDING ARBITRATION AGREEMENT AND CLASS-ACTION WAIVER IN SECTION 15.

By using the Services, creating an account, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must:

  • Be at least 18 years old (21 for handgun purchases; 21 for certain NFA transfers).
  • Be a U.S. citizen or lawful permanent resident, or otherwise legally eligible under 18 U.S.C. § 922 to receive firearms.
  • Be a resident of a state where the item you order is legal.
  • Not be a "prohibited person" under 18 U.S.C. § 922(g) or otherwise barred by federal, state, or local law from possessing firearms, ammunition, or NFA items.

You represent that all information you provide is accurate and that you meet the above requirements. Providing false information in connection with a firearm transaction is a federal crime.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@nativeindustriestx.com if you suspect unauthorized use. We may suspend or terminate accounts that violate these Terms, applicable law, or that we reasonably believe pose a risk to us, our partners, or the public.

3. Products and Services

3.1 Marketplace

Native Industries operates a marketplace for firearms, suppressors, other NFA items, accessories, apparel, and related products. Some listings may be fulfilled by third-party FFL partners or vendors. We reserve the right to cancel any order for any reason, including inventory error, pricing error, suspected fraud, ineligibility, or restrictions in your jurisdiction.

3.2 Firearms and Ammunition

All firearms ship from the seller, distributor, or manufacturer’s licensed FFL to a licensed FFL dealer that you designate. Native Industries TX does not hold an FFL, does not take possession of firearms, and cannot transfer a firearm to you directly. Final transfer at your designated FFL is subject to:

  • Successful completion of ATF Form 4473 at the receiving FFL.
  • NICS background check.
  • Compliance with all federal, state, and local laws at your location.

If a receiving FFL refuses or is unable to complete the transfer, or if you fail the background check, see our Returns Policy for available remedies.

3.3 Suppressors and Other NFA Items

NFA items (suppressors, SBRs, SBSs, machine guns, AOWs, DDs) require ATF approval before transfer. You are responsible for:

  • Filing ATF Form 4 (or Form 5 where applicable) accurately.
  • Paying the $200 tax stamp (or $5 where applicable) unless we have expressly agreed to include or waive it.
  • Providing accurate trust or individual applicant information.
  • Wait times of several months to more than a year for ATF approval.

All NFA sales are final once ATF Form 4 is submitted, except where required by law. See the Returns Policy for details.

3.4 Gun Trust Builder

The Gun Trust Builder is a document-preparation tool. Native Industries is not a law firm and does not provide legal advice. Using the Gun Trust Builder does not create an attorney-client relationship. If you need legal advice regarding your trust, estate, or NFA compliance, consult a licensed attorney.

3.5 Sandhill Crane Flight Co.

Sandhill apparel and accessories are sold and shipped by Native Industries or its designated fulfillment partner. See the Shipping Policy and Returns Policy.

3.6 Collective and Directory

The Collective directory lists third-party gunsmiths, dealers, and service providers. We do not endorse, guarantee, or take responsibility for the work of third parties listed in the directory. All transactions between you and a third-party provider are strictly between you and that provider.

4. Pricing, Fees, and Taxes

  • Prices are shown in U.S. dollars and are subject to change without notice.
  • Product pages display an itemized "all-in price" where applicable, including any ATF tax stamp and FFL transfer fees for NFA items. Standard Title I firearms do not include ATF stamps or NFA fees; if you see such fees listed on a non-NFA product, please notify us — we will honor the correct price.
  • FFL transfer fees charged by your receiving dealer are separate and paid directly to that dealer unless expressly stated otherwise.
  • Sales tax is collected where required by law.
  • Shipping charges are calculated at checkout.
  • In the event of a pricing error, we reserve the right to cancel affected orders and refund payment, whether or not the order has been confirmed.

5. Payment

Payments are processed by Stripe and, where offered, Affirm, Klarna, Cash App Pay, or ACH bank transfer. By providing payment information, you authorize us to charge the total amount, including taxes and shipping.

7. Returns, Refunds, and Cancellations

See the Returns Policy for details, including special rules for firearms, NFA items, ammunition, and custom orders.

8. Prohibited Uses

You may not:

  • Use the Services in violation of any federal, state, or local law, including 18 U.S.C. § 922, the National Firearms Act, or the Gun Control Act.
  • Make a straw purchase (buying a firearm for another person who cannot legally acquire one).
  • Purchase for resale, export, or transfer to prohibited persons.
  • Reverse engineer, scrape, or interfere with the Services.
  • Impersonate any person or misrepresent your identity, citizenship, residency, or eligibility.
  • Use the Services to harass, threaten, or harm others.

Violation of this section may result in immediate account termination, order cancellation, forfeiture of NFA application fees where the ATF has not yet approved the transfer, and referral to law enforcement.

9. Intellectual Property

All content on the Services — text, graphics, logos, product photography, the Native Industries and Sandhill Crane Flight Co. brands, and software — is owned by Native Industries or its licensors and is protected by U.S. and international IP laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission, except for personal, non-commercial use of publicly displayed content.

10. User Content

If you submit reviews, photos, inquiries, or other content ("User Content"), you grant Native Industries a worldwide, royalty-free, sublicensable license to use, reproduce, modify, and display that content in connection with the Services and our marketing. You represent that you have all rights necessary to grant this license. We may remove any User Content at our discretion.

11. Third-Party Links

The Services may link to third-party websites, dealers, or services. We are not responsible for third-party content, practices, or availability. Your use of third-party services is governed by their own terms and policies.

12. Disclaimers

THE SERVICES AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, NATIVE INDUSTRIES DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Manufacturers' warranties, where applicable, are the sole warranty on products. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Firearms and related products are inherently dangerous. You are solely responsible for safe handling, storage, transport, and use in compliance with all applicable laws.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NATIVE INDUSTRIES, ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100. Some jurisdictions do not allow certain limitations; those limitations apply to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Native Industries and its officers, employees, agents, and affiliates from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Services, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) your misuse of any product purchased through the Services.

14A. Native Connect — Dealer Network and Commercial Accounts

Native Connect is our non-captive dealer network. Any business that creates a commercial account is automatically enrolled as a Native Connect applicant. Enrollment does not, by itself, create a partnership, joint venture, franchise, or exclusive dealing arrangement. Membership tiers, buying-group pricing, and any hosted-ERP or website-build services are governed by the separate written agreement you accept during onboarding; where that agreement conflicts with these Terms, the onboarding agreement controls for the subject matter it covers.

  • Non-captive by design: you retain ownership of your own customers, inventory, and data. You may leave the network and export your data at any time, subject to the wind-down terms in your onboarding agreement.
  • Buying-group and distributor pricing (including TMP and other distributor connections) is offered as-is and may change or end without notice; it is not a guaranteed price and creates no resale obligation.
  • Hosted ERP and website-build services are optional add-ons provided on a subscription basis. Native Industries is not liable for lost profits, lost data, or business interruption arising from these hosted services beyond the limits in Section 13.
  • Each member is independently responsible for maintaining its own FFL, SOT, licensing, and compliance. Native Industries does not act as your FFL and does not assume your regulatory obligations.

14B. Background-Check Facilitation

Native Industries does not perform, adjudicate, or guarantee the results of any firearms background check. We are not the NICS system, an FFL, or a consumer-reporting agency.

Where offered, our background-check feature only forwards the information you submit to a licensed third-party provider or to the FFL dealer you designate. The actual eligibility determination is made by that provider, the dealer, and/or the applicable government system at the time of transfer. A completed request through our Services does not authorize a transfer, does not mean you are approved, and does not obligate any dealer to transfer a firearm to you.

  • You consent to the transmission of your information to the provider and dealer for this purpose, and you represent that the information you submit is accurate and truthful.
  • You acknowledge that submitting false information on a background check or ATF form is a federal crime.
  • We do not store Social Security numbers submitted for a check; sensitive identifiers are forwarded to the provider only as required and are not retained by us.
  • To the fullest extent permitted by law, Native Industries disclaims all liability for provider results, delays, denials, or errors, and for any transfer decision made by a dealer.

14C. Community, Forum, and Build of the Week

The community forum, build showcases, comments, votes, and Build of the Week (collectively, "Community Content") are user-generated. You are solely responsible for what you post. Content you submit remains yours, but you grant Native Industries a worldwide, non-exclusive, royalty-free, sublicensable license to host, display, reproduce, and promote it in connection with the Services (including featuring a build as Build of the Week).

  • You may not post content that is unlawful, infringing, defamatory, or that describes the illegal manufacture of firearms, NFA items, or the circumvention of federal, state, or local firearms law.
  • We may remove content, hide posts, adjust or reset votes to counter manipulation, and select or decline any Build of the Week at our sole discretion. Selection is not a contest with consideration and confers no cash prize unless expressly stated.
  • Community Content reflects the views of its authors, not Native Industries. Technical descriptions of builds are shared for discussion only and are not professional gunsmithing, legal, or safety advice.
  • We are protected as an interactive computer service under 47 U.S.C. § 230 and are not the publisher or speaker of user content.

14D. Assumption of Risk and Compliance

Firearms, suppressors, ammunition, and related products are inherently dangerous. You assume all risk associated with their purchase, possession, handling, modification, and use, and you agree to comply with all federal, state, and local laws. You are responsible for confirming that any item is legal in your jurisdiction before ordering. Native Industries is not liable for your failure to comply with applicable law.

14E. Complete Agreement Across All Services

These Terms, together with the Privacy Policy, Shipping Policy, Returns Policy, and any product-, tier-, or service-specific agreement you accept, are intended to provide complete ("360") coverage of your relationship with Native Industries across the marketplace, Gun Trust Builder, Native Connect, Sandhill Crane Flight Co., background-check facilitation, the community, and all other Services. If any provision is unenforceable, the remainder stays in effect, and the disclaimers, limitations of liability, indemnities, and arbitration provisions survive termination.

15. Dispute Resolution — Arbitration and Class Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in [Somervell County, Texas] or, at your election, in the county of your residence. Arbitration shall be conducted by a single arbitrator.

You and Native Industries waive the right to a jury trial and the right to participate in a class, collective, or representative action. Claims must be brought individually.

You may opt out of arbitration by sending written notice to legal@nativeindustriestx.com within 30 days of first accepting these Terms.

Nothing in this section prevents either party from seeking injunctive relief in court for intellectual-property infringement or from bringing individual claims in small-claims court.

16. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, without regard to conflicts-of-law principles. Subject to Section 15, any court proceeding shall be brought in the state or federal courts located in [Somervell County, Texas], and you consent to personal jurisdiction there.

17. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (e.g., IP, disclaimers, limitations of liability, arbitration) will survive.

18. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with a new "Last Updated" date and, where reasonable, communicated by email. Continued use of the Services after changes take effect constitutes acceptance.

19. Miscellaneous

  • Entire agreement: these Terms, together with the Privacy Policy, Shipping Policy, and Returns Policy, are the entire agreement between you and Native Industries.
  • Severability: if any provision is held unenforceable, the remainder remains in effect.
  • No waiver: our failure to enforce any right is not a waiver.
  • Assignment: you may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
