In an open letter to dealers and the public, ATF said it will no longer require approval or registration to make or transfer suppressors, short-barreled rifles, short-barreled shotguns and AOWs. This applies to everyone, not just the people in the lawsuit. Filing a Form 1, 3 or 4 is now voluntary.

Straight answers
- Do I still need ATF approval or a tax stamp?
- Not for suppressors, short-barreled rifles, short-barreled shotguns or AOWs. As of October 9, 2026, ATF no longer requires approval or registration to make or transfer these items, for anyone. The tax was already $0. Machine guns and destructive devices still go through the full NFA process.
- Is there still a background check?
- Yes. Suppressors are still firearms under the Gun Control Act, so buying from a dealer means a 4473 and a standard background check at pickup, the same as buying a rifle.
- Should I register it anyway?
- Many owners will. Some states only allow NFA items that are federally registered, and a registered item is easier to travel with. This change is an enforcement policy, not a new law, so it could change again. Filing a Form 4 is now voluntary, and we will file it for you if you ask.
- Is it legal in my state?
- That depends on your state, and the ATF letter does not change state law. Your advisor checks before you pay, and we will not transfer anything that is illegal where you live.
- Do I need a gun trust now?
- You do not need one to buy. Trusts are still useful if you want family members to legally share possession, or you want a clean plan for passing items down.
- Can I get a refund if I change my mind?
- Yes. Any time before you pick up, you can cancel for a full refund. No runaround.
